Does a Michigan municipality have to opt in for cannabis?
In Michigan, medical cannabis facilities require a municipality to affirmatively opt in by ordinance, while adult-use establishments are permitted by default unless the municipality passes a prohibition ordinance and opts out. Adult-use sites must sit at least 1,000 feet from a pre-existing school, measured property line to property line, unless a local ordinance reduces it.

A statewide cap bill is live — and it reprices every licence in a saturated municipality
Sen. Sam Singh (D-East Lansing), backed by the Michigan Cannabis Industry Association, freezes new licences for testing laboratories, transporters and grows over 150 plants starting in 2026, and caps retail at one dispensary per 10,000 residents per municipality. Existing operators are grandfathered. Requires a three-fourths vote of both chambers, because it amends the voter-approved 2018 Michigan Regulation and Taxation of Marihuana Act.
Detroit would be effectively at its ceiling, not below it. At roughly 633,000 residents a one-per-10,000 cap sets a limit of about 63 retailers against 61 licences in the Treasury FY2025 snapshot — room for roughly two more, not dozens.
The municipalities that freeze immediately are the small, saturated ones. New Buffalo Township holds 26 licences against roughly 2,600 residents, Center Line 10 against roughly 8,000, and Inkster 9 against roughly 24,000 — all far past a one-per-10,000 ratio.
Because existing operators are grandfathered, a cap does not devalue a licence in a saturated municipality — it makes it scarce. The scarcity value of an existing licence in an over-ratio market goes up, not down, and the only way in becomes acquisition of the operating business and its site.

The direction matters more than any single figure. Active licenses ended 2025 at 2,171 — a net decline of 85 and the first annual drop since the program began scaling in 2019 — while average adult-use flower fell to $58.18 per ounce. Compression on the operating side is what is putting cultivation buildings back on the market.

The rule
A municipality must affirmatively adopt an ordinance authorizing medical marihuana facilities. No ordinance means no license — full stop.
Adult-use establishments are permitted by default unless the municipality passes a prohibition ordinance and opts out.
What silence means
Silence is prohibition. A city that has never voted on the question cannot host a provisioning center or medical grow.
Silence is permission. Absent a prohibition ordinance, an adult-use establishment may operate subject to zoning and the state buffer rule.
What to verify
Confirm the authorizing ordinance exists, which facility types it authorizes, and any numeric cap it sets.
Confirm no prohibition ordinance exists, then read zoning: districts, caps, competitive scoring and conditional-use requirements.
Under the Medical Marihuana Facilities Licensing Act, a municipality must adopt an ordinance authorizing medical marihuana facilities before the state will license one there. No ordinance means no license, full stop — and a city that has simply never taken the question up is, in practice, a prohibited city.
The Michigan Regulation and Taxation of Marihuana Act inverts that. Adult-use establishments are permitted unless the municipality affirmatively passes a prohibition ordinance and opts out. So the diligence question is not "did they opt in?" — it is "did they opt out, and what does their zoning ordinance do with what remains?"
Distance requirements
The 1,000-foot buffer is measured parcel line to parcel line
Two buildings can sit more than 1,000 feet apart door to door while their parcels are less than 1,000 feet apart. Under the state adult-use rule the parcel-line measurement governs, so the site fails. Adult-use establishments may not operate within 1,000 feet of a pre-existing public or private school, unless the municipality adopts an ordinance reducing that distance.
How it is measured
The CRA measures property line to property line — not door to door. A parcel-line measurement can disqualify a building whose entrance sits well outside 1,000 feet.
Medical
Medical facilities carry no state-level distance mandate. Any separation requirement comes from local zoning alone.
Certificate of Occupancy comes before CRA inspection
The municipality must issue a Certificate of Occupancy before the CRA will conduct its pre-licensure inspection. The CRA also notifies the local government when an application is filed and allows 14 to 21 days for the municipality to report noncompliance. Both facts belong in the construction schedule, not in a footnote.
